Dr. Sven Bostyn

Associate Professor at the University of Copenhagen, Denmark

Dr. Sven Bostyn (LLB, Lic. Jur., LLM law, PhD law) is Associate Professor of Biomedical Innovation Law at the Center for Advanced Studies in Biomedical Innovation Law (CeBIL https://jura.ku.dk/cebil), Faculty of Law, University of Copenhagen. He also lectures at the Institute for Information Law (IVIR) of the University of Amsterdam and is Visiting Professor (chargé de cours invité) at the Université de Liège. He is also a regular lecturer on CEIPI courses in Strasbourg.

Sven is one of the most prominent authorities in Europe in the area of patent law in general and in life sciences (including patent law relating to pharmaceuticals, biotech, medical devices, SPC’s, software, and artificial intelligence) in particular. He has written extensively on most areas of patent law, and apart from those subjects already mentioned, he has also published in the field of plant patent protection, Plant Variety Rights, software-related inventions, European and international harmonization of patent law, and the Unitary Patent system.

Sven is the single author of more than 60 scientific publications. He is a regular speaker at international conferences, where he speaks on a wide variety of topics, including IP protection in life sciences, pharma patents, SPC’s, regulatory exclusivities in life science, IP issues relating to software and artificial intelligence, patent protection for plants and plant variety rights systems.

 

In the September 2021 webinar series, Dr. Sven Bostyn will give an exclusive three-part crash-course on patents for New Breeding Techniques and plant related inventions (Sept 9, 16 & 30).

Webinar Syllabus: The first webinar in the CIOPORA Academy series 3/2021 will explain the types of patents you can obtain (or be confronted with) in the context of New Breeding Techniques (NBTs). We will look at the various types (products, processes), the patentability requirements, the scope of protection, and how these patents can be enforced.

What will I learn?

R&D collaborations are becoming increasingly important in the field of plant innovation, making modern breeding technologies available to a broad variety of breeding companies and providing opportunities to take a company’s breeding program to a higher level.

Drafting R&D agreements may be challenging in practice. During this course, the structure and key provisions of R&D agreements will be discussed on the basis of practical examples, with a focus on the IP arrangements (ownership and access rights during and after the collaboration) and other legal aspects that need to be taken into account, such as EU competition and state aid regulations.

Various types of R&D collaborations will be touched upon, including (cross sector) multi party collaborations, research institutes and subsidized projects. The participants will learn about the particularities of the types of collaborations and the pitfalls that need to be taken into account when drafting these agreements.

Both members of R&D departments and the legal team are invited to participate and share their experience.

Fleur Tuinzing-Westerhuis

Fleur Tuinzing-Westerhuis is a Counsel at Houtfoff (The Netherlands) and specializes in technology-related Intellectual Property matters, with focus on Patents and Plant Variety Rights. In her daily practice, Fleur represents a wide variety of domestic and international companies that are active in technology-intensive business sectors, such as agrifood and biotech. Fleur is an experienced patent litigator and is one of a handful of lawyers in the Netherlands with extensive experience in litigation relating to national and Community Plant Variety Rights. Over the past seventeen years, Fleur has litigated in various cases before the Dutch courts, the Dutch Board of Plant Varieties and the CPVO. Furthermore, Fleur has broad experience in advising on commercial contracts, including R&D agreements, license and technology transfer agreements.

What will I learn?

The CIOPORA Breeding Academy is a new education program designed specifically for plant breeders and R&D departments of the commercial breeding companies. It provides advanced training in the latest breeding technologies, including New Breeding Techniques (NBT), and the related regulatory aspects.

Webinar 3:

Part 1 by Dr. Ellen de Keyser: Mutagenesis or genome doubling are still most mentioned as EDV-inducing technologies. However, nowadays new technologies are arising that can induce mutations with surgical precision, the “New Breeding Techniques” (NBTs). But how do NBTs differ from the commonly used mutation breeding?

In Europe, NBT-derived plants are to be considered GMOs, hence also the differences with the current GM technologies will be outlined in the course of the webinar. However, also other, less known molecular breeding techniques are available to create an interesting new diversity of genotypes avoiding hurdle of the GM regulation.

In this webinar, a clear technical explanation will be given on both NBTs sensu stricto and the other new promising technologies that can create additional value for breeding companies while creating variation using molecular tools. It will also be briefly explained why these techniques may lead to creation of an EDV.

 

Part 2 by Dr. Edgar Krieger: The concept of Essentially Derived Variety (EDV) is one of the cornerstones of the UPOV 1991 Act, implemented to strengthen the right of original breeders. Based on the text of the UPOV 1991 Act, its Explanatory Notes on EDV, and PBR laws of selected UPOV members, the webinar will provide an overview of the basics of the EDV concept and will explain the requirements for a variety to be declared an EDV as well as the legal consequences of a variety being an EDV. A special reference will be made to EDV resulting from the use of New Breeding Techniques (NBT).

MEET THE SPEAKERS

Dr. ir. Ellen De Keyser

Dr. ir. Ellen De Keyser

Senior Researcher at ILVO Plant, Belgium

Ellen graduated from Ghent University and started her career at ILVO in 2000. Over the course of her academic career, she has been involved in different projects on molecular genetics in azalea, including the development and implementation of several molecular marker techniques. She obtained her PhD (Ghent University) in 2010 on the interaction of phenotype, genotype and gene expression for flower colour and other plant quality traits in azalea. During her PhD, she became an expert in RT-qPCR optimization and analysis for gene expression studies. As such, she is responsible for the set-up of all RT-qPCR projects at ILVO-Plant. She is currently a Senior Researcher at ILVO – Plant Sciences Unit – Applied Genetics and Breeding and is involved in projects on molecular genetics and genomics in several field crops and ornamental plants. Currently, Ellen is working on implementation of the CRISPR/Cas technology in the framework of the ILVO research program. Recently, she has also become one of the contact persons for the open innovation platform of Living Lab Plant.

Secretary General of CIOPORA, Germany

Dr. Edgar Krieger has extensive experience in the field of Intellectual Property Protection for plant innovation and has held the position of the CIOPORA Secretary General since 2004. Before CIOPORA, Edgar worked as a lawyer at an international law firm specializing in IP protection, particularly Plant Breeders’ Rights, advising agricultural breeders in several hundred court cases up to the European Court of Justice. Edgar holds a law degree from the University of Bonn and a degree in business administration from the Aachen University of Applied Sciences. He completed his doctoral dissertation on the topic “Farmers’ Exemption in Germany” at the Philipps University of Marburg.
