About This Event

We are happy to be back in Madrid for a third time with a full-day workshop hosted by The CIOPORA Academy, the world’s first educational program focused solely on Intellectual Property protection and rights in the horticultural industry.

The main objective of this workshop is to provide participants, especially from the fruit sector, with a sound understanding of the main principles of IP in horticulture, ranging from general PBR and licensing, to the application process and trademarks. The small group learning environment is conducive to interactive learning, so questions are encouraged.

101 on Contracts and PBR License Agreements in China (online presentation)

Speakers: Alanna Rennie & Andrew Sim, Baker McKenzie

This lecture will explore the fundamentals of contracts in China, specifically around PBR licensing agreements, exploring practical considerations important for commercialization and some common misunderstandings and oversights by foreign parties. We will also review the standard but important boilerplate sections that should always be included in the agreement.

How vain, without the merit, is the name – Variety Denominations and Trademarks

Speaker: Thomas Leidereiter, Green Rights

At first glance, trademarks and variety denominations seem to protect the same thing. So why should one decide to apply for trademark protection for a trade name in addition to variety protection? These and numerous other questions on the “right” designation of breeding innovations are addressed in this course. The focus is on the economically successful combination of the available IP rights and on avoiding unnecessary and ultimately expensive mistakes.

Cost-effective strategies to enforce PVRs and other plant related rights

Speaker: Tjeerd Overdijk, Vondst Advocaten

During this session, the speaker will walk you through a multitude of issues to be addressed when you need to take enforcement action, with an emphasis on solid pre-trial measures and preparations.
How to collect proof of infringement? What are effective ways to address an infringer and persuade him to enter into a pre-trial compromise?
This session will also provide guidance in regard to a variety of practical issues surrounding litigation and sound preparation, all with a view to doing it in a cost-effective way. Based on his longstanding and wide experience the speaker will be keen to spark a practical and hopefully interactive discussion of all relevant aspects involved with enforcement action, both out of court and in the courts.

National Listings – Roadmap to commercializing your varieties

Speakers: Charlotte Plasman & Judith de Roos, AOMB Intellectual Property

We will give a summary of situations where, if you want to start commercializing your (fruit) variety, you need or don’t need to register in the National List/Catalogue. We will also discuss how this can be done and what the procedure in general entails.
Legislation regarding the marketing of seeds and plant propagating material is not governed on an international level. This means that every country which has variety registration/listing as a requirement for marketing a variety, has their own procedure. The differences and comparisons between the countries will be explained, as will specific requirements such as VCU testing. We will also look into the connection with IP and in which part of the National Catalogue procedure it’s allowed to start commercializing varieties.

Business and Licensing Models in the Fruit Space – The Legal and the Business Perspectives

Speakers: Carolina Cordero di Vonzo, Baker McKenzie & Marco Bertolazzi, CIV

A number of different business models can be adopted to commercially exploit new plant varieties, implying different licenses and contracts. There are no standards nor harmonized models at the international level, and they also vary according to business practices and conventions of each country, species and IP rights available. This lecture aims at providing a general overview, from a business and a legal perspective, of the main family of business models and related contractual implications in the fruit sector, as well as suggesting the best contractual management aspects in attempt to share experience among the stakeholders and start a constructive conversation and exchange of know-how in regard to this matter.

Webinar Syllabus:

The internet’s virtual environment has become an essential part of any commercial business, especially in times when physical contact is still subject to limitations. In many instances, the behavior of businesses and consumers has shifted to prefer the online environment to the offline environment, from remote office work to leisure, and even (grocery) shopping. Intellectual Property protection has also been affected by this shift facing a dramatic surge in online IP right infringements, also in the context of Plant Variety and Patent rights.

In this webinar, Philippe de Jong and Peter Blomme will share valuable insights regarding the IP issues arising in this online context, including:

  • What is an online IP infringement, and is it different from an offline infringement?
  • Who can be sued for online infringements (with attention to intermediaries such as online platforms, shops, and marketplaces)?
  • Where and how can you react if you are the victim of an online infringement?

What will I learn?

During this session, the speaker will analyze the impact on Plant Variety Rights protection for ‘harvested material’ of the recent CJEU decision in the Nadorcott mandarin case. The decision, which is to a great extent inspired by the UPOV Explanatory Notes on harvested material, is potentially dangerous as it suggests a limitative interpretation of what amounts to ‘unauthorized use’, particularly during the period of provisional protection. The speaker will discuss solutions going forward, both in terms of licensing, enforcement and advocacy.

The ciopora Academy testimonialS

“The CIOPORA workshop held in August 2019 in St. Charles/Chicago was a great opportunity to meet with companies active in asexually propagated plants and discuss common challenges in the protection of our crops. The topics were timely and relevant. The session on UPOV, Breeder’s Exemption, and U.S. Plant Patent Law was particularly interesting, as it provided real-life examples of the cross-border legal scenarios. Thanks to the CIOPORA team for always putting together a thoughtful and well-run program"

"CIOPORA Academy workshop was a great opportunity to learn varying perspectives on plant IP. All topics presented had value as they pertain to my daily work; however, I was particularly interested in the topics on Utility Patents and Plant Variety Protection (PVP) for asexually reproduced plants. Both speakers provided in-depth analysis of the different scope of protections under these two systems. The comfortable atmosphere of the workshops at the Hotel Baker was a wonderful location to network with like-minded colleagues."
