He has written extensively on most areas of patent law, and apart from those subjects already mentioned, he has also published in the field of plant patent protection, Plant Variety Rights, software-related inventions, European and international harmonization of patent law, and the Unitary Patent system.

Sven is the single author of more than 60 scientific publications. He is a regular speaker at international conferences, where he speaks on a wide variety of topics, including IP protection in life sciences, pharma patents, SPC’s, regulatory exclusivities in life science, IP issues relating to software and artificial intelligence, patent protection for plants and plant variety rights systems.

In the September 2021 webinar series, Dr. Sven Bostyn will give an exclusive three-part crash-course on patents for New Breeding Techniques and plant related inventions (Sept 9, 16 & 30).

Webinar Syllabus: In this final session, we will look at the case law of the European Patent Office (EPO) in relation to plant related inventions.

The Boards of Appeal have decided various cases over the years, most of which have remained controversial to this day. We will critically discuss the relevant case law, and analyze the effects which these decisions may have on the interface between patent law and Plant Variety Right.

What will I learn?

Gene editing has emerged in the last decade as a new and precise way of altering the genetic material of plants and animals. Being a relatively novel technique, since its introduction, gene editing has found a wide array of applications in different fields of research, with its inventors awarded the Nobel Prize in 2020.

This webinar will cover the current applications of gene editing in agricultural and horticultural crops around the globe in the last decade, highlighting major achievements in the field of plant breeding. Furthermore, the current regulatory environment of gene editing will be presented covering Europe (EU 27 + non-member states), as well as some major import and export markets and developing countries. The differences between policymakers’ approaches to gene editing regulation will be outlined, providing an overview of the current regulatory frameworks and explanations of specific regulations.

What will I learn?

Companies grow their global presences, and an increasing number of employees not only work cross-jurisdiction but also remotely from their homes. Questions of ownership and remuneration of employees’ inventions become more complex – and we see significant differences across the globe. While in Switzerland employee inventors rarely are entitled to compensation in addition to agreed salaries, in Germany an additional remuneration is the standard. The amount of which is still often disputed; we regularly read about employees awarded significant payments by courts, as their invention turns out to be particularly successful. In addition, survey show that invention reward policies enhance innovation.

While focusing in particular on Switzerland, Germany, Italy, China, Hong Kong and the US, we will guide you through the global “jungle” of remuneration schemes and invention reward options, provide insights into how employee inventor compensation is calculated and outline the pitfalls you should be aware of.
