What will I learn?

There are currently three options that exist in the U.S. for protecting a novel asexually reproduced plant variety: Plant Patent, “Varietal” Utility Patent, and Plant Variety Protection. Which of these is most appropriate for a particular variety depends upon numerous factors, including the timing of the first sale, anticipated value of the variety, and the competitive activities you are trying to prevent. Additionally, these types of protection are not mutually exclusive, so a breeder could obtain multiple types of protection over a variety. Thus, it is important for a breeder to consider which type(s) of protection should be secured for a particular variety. This presentation will discuss the factors and decision points, and will further analyze how multiple types of IP protection can be combined to further secure the variety and, in certain cases, to overcome challenges that are imposed by the doctrine of patent exhaustion.

She prepares and prosecutes the U.S. and foreign patent applications for inventions related to all aspects of life science. She is involved in FDA Orange Book submissions and Patent Term Extension Applications and also assists clients with preparing opinions relating to patentability and freedom to operate. Stephany collaborates in patent interferences and inter partes review proceedings before the U.S. Patent Office’s Patent Trial and Appeal Board (PTAB).

What will I learn?

In the CIOPORA Academy webinar series in September 2020, three UPOV experts elaborate on the technical aspects of the UPOV regime important to plant breeders.

Webinar 3:

VARIETY COLLECTIONS: The final session of the webinar series will deal with all ins and outs of the Variety Collections (reference collections). The speakers will elaborate on why a variety collection of existing and known varieties is essential for evaluating new candidate varieties.

VARIETY DESCRIPTIONS: A look at variety descriptions; what is the continuing value of a variety description for PBR?

USE OF FOREIGN DUS REPORTS: Learn how existing varieties are considered when testing a new variety and ways UPOV members collaborate to organize DUS examination, takeover existing DUS test reports and the benefits and challenges of cooperation. How is the effect
of the environment on characteristics considered when using existing DUS test reports and variety descriptions and why is it essential to have access to material of other varieties in the growing trial? Hear about cooperation between authorities and breeders in DUS examination and the potential role in the take-over process which DNA techniques may play.

MEET THE SPEAKERS

Chris Barnaby

Assistant Commissioner/PVR Manager at the PVR Office, IPONZ

Chris has been with the Plant Variety Rights Office of the IP Office of New Zealand (IPONZ) since 1991 and is currently group manager and NZ representative for several UPOV bodies. He has extensive expertise in Plant Variety Protection, DUS testing, plant taxonomy and variety denominations. At UPOV, Chris is a past chairman of the UPOV Technical Working Party for Fruit Crops, the UPOV Technical Working Party for Ornamentals and Forest Trees and the UPOV Technical Committee (2008 – 2010) and is currently the nominated chair again for UPOV Technical Working Party for Fruit Crops. Other IPONZ and UPOV activity include advisor to East Asian PVP technical programs and training initiatives. In addition to his positions at IPONZ and UPOV activity, Chris acted as Editor for the International Plant Propagators’ Society, New Zealand Region. Chris is a member of the Royal New Zealand Institute of Horticulture and the International Plant Propagators’ Society. He holds a Master Degree in Horticultural Science with Honours (1990).

Senior PVP Policy Advisor & Chair of the UPOV Technical Committee

Cornelis (Kees) van Ettekoven has been active in horticulture and Plant Variety Protection for over 45 years. Kees worked in various positions at Naktuinbouw, the Netherlands Inspection Service for Horticulture, consecutively serving as a Head of IT Department, the Registration and Documentation Department, and the Variety Testing Department, overseeing the Dutch DUS testing of all species for Plant Breeders’ Rights and National Listing. Today, Kees serves as a Senior PVP Policy Advisor, is a member of the Plant Breeders’ Rights chamber of the Court of Justice in the Hague, and coordinates the IPKey program for China, Latin America and South-East Asia at the CPVO. At UPOV, he is a past Chairman of the UPOV Technical Committee, the UPOV Technical Working Group Vegetables, and the UPOV Working Group on Biochemical and Molecular Techniques and DNA-Profiling in Particular (BMT).

Head of Technical Affairs and Regional Development at UPOV, Switzerland

Leontino Taveira is Head of Technical Affairs and Regional Development at UPOV. He works with policymakers in Latin America and the Caribbean promoting accession to UPOV and assisting the implementation of the UPOV system. With a background in agriculture and plant breeding, he is in charge of organizing the technical work of UPOV, including the development of Test Guidelines and guidance for examination of distinctness, uniformity and stability. Leontino started his career in the private sector as agronomist and nursery manager for ornamental plant production. For the past 18 years, he has worked with Plant Variety Protection in the public sector, both at the national and international levels.
