What will I learn?

In the CIOPORA Academy webinar series in September 2020, three UPOV experts elaborate on the technical aspects of the UPOV regime important to plant breeders.

Webinar 1:

INTRODUCTION: You will learn about UPOV and its role in the international system of Plant Breeders’ Rights (PBRs) and statistics on numbers of PBR grants. The role of the UPOV Office and how breeders and applicants can become involved in the work of UPOV will be explained.

You will receive an explanation and demonstration of PLUTO, the plant variety database, and UPOV’s website which contains important information for breeders and applicants. Who is testing what species, where can I apply and which countries have established cooperation?

DUS EXAMINATIONS & PLANT CHARACTERISTICS:  The expert speakers will share their knowledge on plant characteristics including the types of characteristics and their usefulness for the DUS decision. Why are not all characteristics important in breeding suitable as DUS  characteristics? How are characteristics observed and how can the method of observation influence the quality of the decision? How do different countries harmonize their use of characteristics? The use of disease resistance characteristics will be explained.

The ciopora Academy testimonialS

“The CIOPORA workshop held in August 2019 in St. Charles/Chicago was a great opportunity to meet with companies active in asexually propagated plants and discuss common challenges in the protection of our crops. The topics were timely and relevant. The session on UPOV, Breeder’s Exemption, and U.S. Plant Patent Law was particularly interesting, as it provided real-life examples of the cross-border legal scenarios. Thanks to the CIOPORA team for always putting together a thoughtful and well-run program"

"CIOPORA Academy workshop was a great opportunity to learn varying perspectives on plant IP. All topics presented had value as they pertain to my daily work; however, I was particularly interested in the topics on Utility Patents and Plant Variety Protection (PVP) for asexually reproduced plants. Both speakers provided in-depth analysis of the different scope of protections under these two systems. The comfortable atmosphere of the workshops at the Hotel Baker was a wonderful location to network with like-minded colleagues."

What will I learn?

On January 31, 2020, the UK left the European Union. As a consequence, the EU Intellectual Property rights, including Plant Variety Rights (Community PVR) will have to be transferred from the single Community PVR regime to the national UK regime. While the general legal framework for this process is provided by the EU-UK Withdrawal Agreement, Plant Variety Rights title-holders have to set in motion a number of measures to maintain and further protect their titles on the territory of UK. In the live webinar on May 7, DAFRA’s Head of Varieties and Seeds Policy Andrew Mitchell will provide participants with detailed explanations of the rules that will apply to PVR titles in force and the ongoing PVR applications during and after the Transition Period.

What will I learn?

The United States of America recently amended its Plant Variety Protection Act to extend plant variety protection to asexually reproduced plants. It plans to start accepting applications by December 2019.

This webinar overviews the US Intellectual Property protection system for plants and systematically describes the application, examination, and certificate issuance processes of the US Plant Variety Protection Office (PVPO).

It shows how to register for, and use, the PVPO electronic application system – an application management system that provides a seamless interface between customers and PVPO, from application submission and amendment, fee payment, application examination, to correspondence with PVPO staff.

It provides clarification and guidance for submitting a complete application, and explains the PVPO process of examining Distinctness, Uniformity, and Stability.

After attendance, breeders should find it fairly easy to submit an application and know what to expect for the examination and certificate issuance processes.

When?

Two sessions of the webinar will be held to enable participation in all time zones.

The sessions are scheduled in the US Eastern Standard Time (EST) to match the speaker’s time zone.

Speaker’s time zone: EST (GMT -4)

Duration of each session: ca. 1,5 h

Session 1: 12:00 pm (noon) EST, December, 12/2019.
