Philippe specialises in Intellectual Property law, with a particular focus on Patents, Plant Variety Rights and parallel import issues. Philippe also has extensive experience in regulatory matters concerning the life sciences and agri-food industries. Other areas of practice include medical law, media law and fair trade practices in a variety of sectors.

Philippe regularly lectures at conferences and seminars and publishes articles in various leading legal journals relating to his area of expertise.

He has worked as a consultant for the EU Plant Variety Office and is also an active member of various lawyer and sector organisations, including: the European Patent Lawyers Association (EPLAW), Euroseeds, the Licensing Executives Society (LES), and the International Community of Breeders of Asexually Reproduced Horticultural Plants (CIOPORA).

Peter Blomme specialises in Intellectual Property rights such as Trademarks, copyrights, and software protection. He has obtained extensive experience litigating for clients covering many sectors.

Peter obtained a Master in Law degree at the Katholieke Universiteit Leuven in 2012, and completed an LL.M. at the London School of Economics and Political Sciences in 2013, specialising in Intellectual Property Law.

Peter has been nominated as a Notable Practitioner 2020 and Rising Star 2019 by ipstars.com, and is a member of the Belgian Copyright Law Association (BVA), the Benelux Trade Mark and Design Association (BMM), and MARQUES.

What will I learn?

Gene editing has emerged in the last decade as a new and precise way of altering the genetic material of plants and animals. Being a relatively novel technique, since its introduction, gene editing has found a wide array of applications in different fields of research, with its inventors awarded the Nobel Prize in 2020.

This webinar will cover the current applications of gene editing in agricultural and horticultural crops around the globe in the last decade, highlighting major achievements in the field of plant breeding. Furthermore, the current regulatory environment of gene editing will be presented covering Europe (EU 27 + non-member states), as well as some major import and export markets and developing countries. The differences between policymakers’ approaches to gene editing regulation will be outlined, providing an overview of the current regulatory frameworks and explanations of specific regulations.

Senior Researcher at Julius Kuehn Institute for Biosafety in Plant Biotechnology
As a Senior Researcher at the Julius Kuehn Institute (Germany), Dr Thorben Sprink leads the Working Group for Genome Editing and Synthetic Biology. In his research activities, Thorben focuses on the development of new technologies for targeted genome modifications, driving research in the area of DNA-free CRISPR/CAS-Technologies and the analysis of the off-target events. Thorben has extensive expertise in the area of New Breeding Techniques regulations. He is a member of the International Society for Biosafety Research.

What will I learn?

R&D collaborations are becoming increasingly important in the field of plant innovation, making modern breeding technologies available to a broad variety of breeding companies and providing opportunities to take a company’s breeding program to a higher level.

Drafting R&D agreements may be challenging in practice. During this course, the structure and key provisions of R&D agreements will be discussed on the basis of practical examples, with a focus on the IP arrangements (ownership and access rights during and after the collaboration) and other legal aspects that need to be taken into account, such as EU competition and state aid regulations.

Various types of R&D collaborations will be touched upon, including (cross sector) multi party collaborations, research institutes and subsidized projects. The participants will learn about the particularities of the types of collaborations and the pitfalls that need to be taken into account when drafting these agreements.

Both members of R&D departments and the legal team are invited to participate and share their experience.

Fleur Tuinzing-Westerhuis

Fleur Tuinzing-Westerhuis specializes in technology-related Intellectual Property matters, with focus on Patents and Plant Variety Rights. In her daily practice, Fleur represents a wide variety of domestic and international companies that are active in technology-intensive business sectors, such as agrifood and biotech. Fleur is an experienced patent litigator and is one of a handful of lawyers in the Netherlands with extensive experience in litigation relating to national and Community Plant Variety Rights. Over the past seventeen years, Fleur has litigated in various cases before the Dutch courts, the Dutch Board of Plant Varieties and the CPVO. Furthermore, Fleur has broad experience in advising on commercial contracts, including R&D agreements, license and technology transfer agreements.
